Terms of Use

By using the Ourlog website and services (hereafter, the Services) you are agreeing to be bound by the following terms and conditions ( Terms of Use ). Any correspondence concerning Ourlog shall be done with Pranav Rao ( hereafter, Pranav ) in his individual capacity. Pranav reserves the right to update and change the Terms of Service, at any time. Pranav will make reasonable efforts to inform you about any changes to these terms of service. These terms of service apply to any person (such as a self-employed tutor) or business (such as an agency) with an Ourlog company account ( you ). Some clauses relate to both you and any user whom you intentionally or unintentionally give access to Ourlog (herein after your users ). Any new features that augment or enhance the current Service, including the release of new tools, new functionality (including, without limitation, the receipt and disbursement of payments), website features or other resources, shall be subject to the Terms of Service. To be clear from the outset, by using our Services (including our site), you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our Services. We recommend that you print a copy of these terms for future reference. Continued use of the Service after any changes in future to these Terms of Service shall constitute your consent to such changes.

Section A: Account Terms

  1. You must provide your legal name, a valid email address, and any other information requested in order to complete the onboarding/registration process.
  2. Your login credentials may only be used by one person a single set of login credentials shared by multiple users is not allowed.
  3. Ourlog requires that clients sign up using an existing Google®account. Ourlog asks for permission to use your Google®username and e-mail account, and to send e-mail on your behalf. If you do not grant these permissions, Ourlog will not function properly. Ourlog encourages you to read and save the Terms of Use and Privacy Policy of Google®.
  4. Where you are an agency with an account, you may create login credentials for as many administrators, editors, and readers as you need.
  5. You are responsible for maintaining the security of your account and password. Ourlog cannot and will not be liable for any loss or damage from your failure to protect your login information. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us.
  6. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction or the United States of America. You agree to indemnify us in respect of any breach or violation of any such laws, meaning that you will be liable for any loss or damage we suffer as a result of or in connection with such breach or violation.
  7. You are responsible for all Content posted, activity conducted and all persons who access (or even just view or see screenshots of) our Services through your account or internet connection. You should not permit any person who is not the account holder to access or interact with your account or our Services without first making them aware of these Terms of Service. In any event, all such activity that occurs under your account including Content posted by or suggested by other people shall be your responsibility (except where Ourlog has accessed or is performing maintenance on any part of the site or your account).
  8. If you upload the data of minors (individuals under the age of 18 years), you are responsible for obtaining consent from the minor s parents or guardians.
  9. You retain all of your ownership rights in your Content, but you are required to, and you hereby do, grant Ourlog a non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the Services.
  10. We do not guarantee that our Services or any content on our site, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Services for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

Section B: Payments and Refunds

  1. Pranav charges you for every invoice you generate and/or send. At the time of this writing, the per-invoice price is $1.45 USD. You may pay using cash or a bank transfer via Zelle. For cash, please contact Pranav directly for where to send payment using the contact e-mail address, contact@ourlog.app .
  2. Upon signing up, the first 10 invoices you create are free of charge.
  3. Payment for invoices is non-refundable.

Section C: Cancellation and Termination

  1. You alone are responsible for the proper cancellation of your account. You may cancel your account by emailing contact@ourlog.app.
  2. Pranav may cancel or suspend your account immediately without notice for any of the following reasons: Illegal activity involving or in any way relating to use or misuse of the Service. Any activity by you which results in a significant increase in the costs to Pranav when providing the Ourlog service. Any activity by you or your users which defames Pranav or Ourlog, or damages Pranav or Ourlog s reputation.
  3. In the event of cancellation or long-term suspension, Pranav will provide exports of your data as a CSV file and PDF archive free of charge unless prevented from doing so by law. If any further data is required, Ourlog will make a reasonable effort to provide that data in a usable format charging a reasonable hourly rate for that work (being no less than $60 per hour). Ourlog will also refund any unused invoices using the rate you paid upon their purchase, unless prevented from doing so by law.
  4. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content associated with your Account.
  5. Ourlog reserves the right to refuse service to any new customer for any reason.
  6. Ourlog reserves the right to modify the service at any time without notice. Unless otherwise agreed all customers will be provided with the same service.

Section D: Liability

Whether you are an end user (an individual) or agency/business

  1. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our agents or subcontractors and for fraud or fraudulent misrepresentation.
  2. All other statutory rights of individual end users are unaffected.
  3. Our maximum liability for errors, omissions, negligence, and defective digital content which is exclusively and wholly the fault of Pranav shall in all cases not otherwise excluded or limited in these Terms of Service shall be capped at the level of 50% of the amount of fees (being fixed monthly fees plus usage fees) paid by or on behalf of the affected user in the preceding 12 months before the default giving rise to the claim arose.

If you are an agency/business

  1. We exclude all implied conditions, warranties, representations or other terms that may apply to our Services.
  2. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: use of, or inability to use, our Services; or use of or reliance on any content displayed on our site.
  3. In particular, we will not be liable for: loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

Section E: Control, Copyright and Content Ownership

  1. Pranav owns or licenses the intellectual property rights to any and all protectable components of the Service, including but not limited to our site, any material published on it, the name of the Service, artwork and end-user interface elements contained within the Service, many of the individual features, and the related documentation. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  2. You may not (without our express permission) copy, modify, adapt, reproduce, distribute, reverse engineer, decompile, or disassemble any aspect of the Service which Pranav owns. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
  3. Pranav claims no intellectual property rights over the exact Content you upload or provide to the Service.
  4. We may transfer our rights, role, responsibilities contained in these Terms of Service and the legal agreement embodied by it, to someone else (such as a purchaser of Ourlog in future). We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

Section F: How We Use Your Information (Data Protection)

  1. We do not sell, trade, or rent users personal identification information to others. We may share generic aggregated data such as demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers. We may use third party service providers to help us operate our business or administer activities on our behalf. We may share your information with these third parties as part of our business operations.
  2. We treat your end user database with the greatest respect and will never share its contents with another user of Ourlog. Individuals can only create one Ourlog account for each business of which they are an employee.

Section G: General Conditions

  1. Your use of the Service is at your sole risk. The service is provided on an as is and as available basis.
  2. We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party s intellectual property or these Terms of Service.
  3. You warrant that any Content inputted by you shall not reasonably offend, cause harm or distress to any person or be unlawful, libelous, threatening, obscene, pornographic, defamatory, nor shall it violate any person s intellectual property. You will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer (towards a third party) as a result of your breach of warranty.
  4. You warrant that you will not input any Personally Identifiable Information into Ourlog. This includes, but is not limited to; Social Security numbers, Dates of Birth, financial information such as IBANs or Routing Numbers, or health information such as medical history or insurance information.
  5. You agree not to resell, duplicate, reproduce or exploit any part of the Service without the express written permission of Pranav.
  6. It is your responsibility to check every invoice and payment order to make sure they are correct before receiving or dispensing funds. Ourlog allows you to generate previews of invoices. These are strictly for preview and shall not be sent to your customers. If you are found to be sending previews of invoices to customers, you will be found to have breached the terms of use, and your account and data may be deleted.
  7. You may not use the Service to store, host, or send unsolicited email (spam) or SMS messages.
  8. You are solely responsible for securing and backing up your Content. TutorCruncher may keep back-ups and archives for its particular lawful purposes (in compliance with its privacy policy and other requirements) but you should not rely on these back-ups or assume any guarantee that they will be made accessible to you (but we will do our best to assist on each occasion).
  9. You must not misuse our Services by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You are responsible for configuring your information technology, computer programs and platform to access our site. You should use your own virus protection software.
  10. You must not attempt to gain unauthorized access to our site or Services, the server on which our site is stored or any server, computer or database connected to Ourlog. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offense under the Computer Fraud and Abuse Act (CFAA). We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Services will cease immediately.
  11. Pranav does not warrant that (i) the Service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
  12. Where our Services contain links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.
  13. You may create links to our website or refer to our Services when you interact with others but you must not establish a link in such a way as to suggest any form of employment, affiliation, approval or endorsement on our part where none exists. We reserve the right to withdraw linking permission without notice.
  14. Parts of the Services may include information and materials uploaded by other users, (including to bulletin boards, blogs, and chat functions). This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.
  15. Pranav, their affiliates and their sponsors are neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.
  16. If any provision of the Terms of Service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.
  17. The failure of Pranav to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Pranav and govern your use of the Service, superseding any prior agreements between you and TutorCruncher (including, but not limited to, any prior versions of the Terms of Service).

  19. Any dispute over these terms of service and any disagreement between Pranav and their customers will be judged under the laws of the United States and the state of California, and the courts of the state of California shall have exclusive jurisdiction.

Pranav is committed to providing a reliable and stable platform to support the operations of your tutoring business. While every effort is made to ensure consistent availability, occasional service interruptions may occur due to factors such as third-party service provider issues or unexpected technical faults. We aim to minimize disruption and resolve incidents as promptly as possible. During any such incidents, users will receive updates via email or other relevant communication channels.
Compensation Policy
Pranav does not offer compensation for losses or damages, including consequential or indirect damages, arising from service downtime or system issues. This approach is consistent with industry standards across software-as-a-service (SaaS) providers. Offering compensation in such cases would require significant financial and legal resources, which would in turn necessitate substantial price increases ultimately to the detriment of our clients. This policy applies universally and without exception, ensuring fair and equal treatment for all clients. Language Policy
Ourlog is provided in English only. If the Website, Privacy Policy, Terms of Use, or other document is translated by a third party such as a family member, friend, or computer program; Pranav Rao is not responsible for the accuracy of the translation.
